Invested in Non Shari’ah Compliant Stock ? Know what to do!

Question :
If a person invests in a company whose primary business is not permissible in Shari’ah and the person making the investment is in loss or gain, then what is the ruling in both cases?

Answer :
If a person invests in a company whose primary business is not permissible in Shari’ah and the person making the investment is in profit, then the amount of profit must be given as charity without any intention of sawab
If that person is in loss, then he must bear the loss.

کسی شخص نے اگر ایسی کمپنی میں سرمایا کاری کی جس کمپنی کا بنیادی کاروبار  شرعاً جائز نہ ہو اور سرمایہ کاری کرنے والا شخص نقصان یہ فائدہ میں ہو تو دونوں ہی صورت میں کیا حکم ہے؟

:جواب

اگر کوئی شخص ایسی کمپنی میں سرمایہ کاری کرتا ہے جس کا بنیادی کاروبار شریعت میں جائز نہیں ہے اور سرمایہ کاری کرنے والا نفع میں ہے تو نفع کی رقم کو بلا نیت ثواب کے صدقہ کرنا ہوگا۔
اگر وہ شخص نقصان میں ہے تو اسے نقصان برداشت کرنا ہوگا۔

But if that company does not meet other Shariah conditions (eg, interest bearing debt, non-Shariah income ratio or fixed assets ratio) then what will be the Shari’ah ruling on the profit and loss from the investment.

Answer :
If a person invests in a company whose primary business is permissible in Shari’ah, but if that company does not meet other Shariah conditions (eg, interest bearing debt, non-Shariah income ratio or fixed assets ratio) then profit must be given as charity without any intention of sawab and if there is a loss, he/she can wait until the invested capital is recovered.

اگر کوئی شخص ایسی کمپنی میں سرمایہ کاری کرتا ہے جس کا بنیادی کاروبار شریعت میں جائز ہے۔ لیکن اگر وہ کمپنی دیگر شرعی شرائط (مثلاً ،سودی قرض ،غير شرعی آمدنی  کا تناسب یا جامد اثاثوں کا تناسب) پر پورا نہیں اترتی تو سرمایہ کاری سے ہونے والے نفع و نقصان کا شرعی حکم کیا ہو گا ؟

:جواب
اگر کوئی شخص ایسی کمپنی میں سرمایہ کاری کرتا ہے جس کا بنیادی کاروبار شریعت میں جائز ہے۔ لیکن اگر وہ کمپنی دیگر شرعی شرائط (مثلاً ،سودی قرض ،غير شرعی آمدنی  کا تناسب یا جامد اثاثوں کا تناسب) پر پورا نہیں اترتی تو سرمایہ کاری سے ہونے والے نفع کی رقم کو بلا نیت ثواب کے صدقہ کرنا ہوگا ۔اور اگر نقصان میں ہوں تو سرمایہ کاری کی ہوئی رقم کی وصولیابی تک انتظار کرنے کی گنجاش ہے۔

  1. For the second point, What if we hold the stock, until it is compliant? I am investing in stock for long term like 5 to 10 years, So when I checked compliance after purchasing the stock, it was non-compliant due to debt ratio, but the stock later becomes debt free, and is now complaint. So what will be done?
    And similarly if the stock was complaint but later down the years its non-complaint, 9due to interest-bearing income), what to do?

    • IslamicStock App ke Rule 4 ka matlab hai:

      – Illiquid Assets ka Total Assets se ratio kam az kam 20% hona chahiye.
      – Illiquid Assets woh hote hain jo foran bechay nahi ja sakte, jaise land, building, machinery, aur plant.
      – Liquid Assets woh hote hain jo foran cash me convert ho sakte hain, jaise cash, receivables, aur short-term investments.
      – Agar kisi company ka illiquid assets ka ratio 20 percent se kam ho, to wo shariah non-compliant ho jati hai.

    • There are many Shari’ah screening methodologies (fatawa) that are used for Shari’ah screening of  the stocks and their approaches have good scholarly opinions behind them, so we are not against any specific approach.
      We need to follow One Screening methodology(fatwa) after proper understanding

    Ek sawaal puchna tha maine ek non compliance company me invest kiya tha jisme mujhe 1 lac profit hua tha
    Aur ek dusri non compliance company me invest kiya tha jisme mujhe 80,000 ka nuksaan hua
    To mujhe 1 lac sadqa karna padega ya 20,000
    Kindly help.

  4. I have invested in a non compliant stock in which I made profit of 30000. Now for that I also need to pay capital gain tax of 6000 so is it permissible to pay tax from the part of profit and give away remaining profit of 24000 or do I need to give away 100% profit of 30000 and pay 6000 tax from my Shariah income?
